What is important to know is options exist outside of bankruptcy for those who need or want to explore those options. Some people can't file for bankruptcy for various reasons; some don't want to file, and for some it simply isn't the best option. We assess all financial situations with the intent to use bankruptcy as a tool only when it is the best option available. For instance, with a Chapter 128 petition, individuals can ask the Wisconsin Circuit Court in the county where they reside to approve a plan to repay their debts in full under Chapter 128 of the Wisconsin Statutes, which protects them from any collection on those debts, usually in the form of garnishment of wages, and which in turn can be beneficial on their credit and provide other benefits. We can also explore keeping your home when faced with foreclosure by working with the mortgage company to obtain a modification of the mortgage terms, by putting past-due payments back into the loan, by lowering the interest rate, or in other ways working out the default to avoid the foreclosure. For other debts such as credit cards or medical bills, we can contact creditors to attempt to lower interest rates and/or set up payments to avoid harassing collections calls and get you back on track to financial stability and avoid harsh collection tactics by the creditors or their collection representatives.
